San Marino Constitution



San Marino Constitution is regarded as the most important legislative document of the country. Several legislative acts and declarations that were passed were included in the Constitution of San Marino. The statutes of 1600 and the Declaration of Citizen Rights in 1974 are the most important parts of the Constitution. Though San Marino is a small country, the Constitution of the nation has several influences from Roman Customary Law and from Corpus Juris Civilis.

The main part of San Marino Constitution consists of the Statutes of 1600, which are again divided into six books. The Constitution was actually brought into function on 8th October in the year 1600. This was originally written in Latin. The old legal system in the country was renewed at a later stage. These statutes are still followed in the country and that makes the Constitution of San Marino one of the oldest in the world.

Book I contains 62 articles and gives a description of the various courts and councils in the country along with few administrative positions. The book also provides instructions to change or alter the laws. Book II has 75 articles dealing with civil law processes and salary of civil servants, while the Book III includes 74 articles and covers all the topics related to criminal law. Topics related to judges, their appointment and appeals are mentioned in Book IV. Book V and VI consist wide array of common topics that are dealt with in our daily lives.

The Declaration of Citizen Rights was adopted by the San Marino Constitution on 12th July, 1974. This Declaration provides the citizens with many rights like sovereignty, equality, freedom and universal suffrage. This was again amended in the year 2002 and more constitutional details were included. The Constitution of San Marino helps in guiding the country legally.
