The Constitution of the Socialist Republic of Vietnam ordains that the President of Vietnam is the Head of the State both within the country and outside it. The President is elected for his five year tenure by the National Assembly. He remains answerable to the National Assembly for his actions. He remains in the office even after the completion of the term of the National Assembly till a new incumbent is decided upon. As the constitutional head of state, the Vietnamese President has been assigned with the power to make a proposal to the National Assembly to elect and appoint the Vice President, the Prime Minister, the President of the Supreme People’s Court and the Head of the Supreme People’s Office of Supervision and Control. He is empowered by the Constitution to declare laws. He has the command of the national army and is the Chairman of the National Defense and Security Council. He has the power to confer different titles and ranks, reprieve sentences and grant pardons, and also the power to grant Vietnamese nationality. In the case of the President’s absence from his office, the Constitution ordains the Vice President to work on the formers behalf. Nguyen Minh TRIET is the current President of Vietnam.
