There are certain requirements for a potential immigrant to the US for being considered under the Visa waiver program, such as:
The traveler must be a citizen of UK, traveling on a valid, individual machine readable passport. Any person whose passport indicates that he/she is a British Subject, British Dependent Territories Citizen, British Overseas Citizen, British National (Overseas) Citizen, or British Protected Person does not qualify for travel without a visa. Again, any passport stating that its holder has Right of Abode or indefinite leave to remain in the UK does not qualify for visa free travel
The traveler is traveling for business, pleasure or transit only
The traveler will stay in the United States for 90 days or less
In case the traveler is entering the US by air or sea, then he/she has to have a return or onward ticket, a completed form I-94W, etc.
In case the traveler is entering through Canada or Mexico, he/she must be in possession of a completed form I-94W, issued by the immigration authorities at the port of entry, and a US $6 fee.
Cases of Ineligibility :
There could be cases where a traveler is not entitled to enter the USA. Such grounds could be of:
- Any kind of arrest (even without a criminal conviction)
- Criminal record
- Communicable disease
In such cases, the travelers have to apply for special restricted visas.
Refusal of US Visa :
Those travelers who have been refused visa under Section 221(g) or 214(b) of the Immigration and Nationality Act are not ineligible to obtain travel visa under the Visa Waiver Program. Those travelers will be questioned by an immigration official at the U. S. port of entry regarding the denial of visa by the Embassy or Consulate. The concerned traveler should carry with him/her evidence of his/her intention to depart the United States at the end of the visit.
Of late, however on US demand, it has been made a rule that those with new passports either have "biometric" data such as digital images or fingerprints or be in possession of a visa - to enter the US.
