Investor Visa USA

Of the various types of non-immigrant visas to the USA, the E category visa is meant for the foreign investors who intend to engage in business in the US. Such potential investors planning to invest a substantial amount of capital in an American enterprise, and who will develop and direct the enterprise, can apply for E2 visa .

However the Investor Visa USA can be granted only if there is a Treaty of Commerce and Navigation between the applicant's country and the US (currently 65 countries have such treaty with the US).

If the investor is located in the US, he/she may apply to the US Citizenship and Immigration Services ( USCIS ) for a change of status, extension of stay, or change of employment. In case the investor is outside the US, the E2 category does not require a petition for employment. In such case, the investor can apply for the E2 visa on his or her own behalf directly to a US consular office abroad. The visa-holders can reside in the United States as long as they continue to maintain their entrepreneurial status.

Conditions for Investor Visa :

Low investments are less likely to qualify as a case to grant E 2 visa
The level of investment must justify the treaty national's (or investor's employees) presence in the United States.
The investment must be an operating business (mere buying property or stocks and bonds does not qualify).
A substantial part of the investment must have been made before applying for E2 status. The investment involved must place lawfully acquired, owned, and controlled capital at commercial risk with a profit objective, and be subject to loss if the investment fails.

2. the applicant owns at least 50 percent of the enterprise, and will direct or develop the enterprise.
3. the investor has invested in or is actively investing in the enterprise;
4. the investment is substantial, i.e. it ensures the investor's financial commitment to the successful operation of the enterprise
5. the investment enterprise is not a marginal enterprise;
6. in case the applicant is not the principal investor, he/she must be employed in an executive or supervisory capacity, or is possessing skills that are highly essential to the operations of the commercial enterprise.
7. the applicant intends to depart the United States upon the expiration of E2 status.

E2 Dependents :

Spouses and unmarried children (under age 21), irrespective of nationality, are eligible for derivative E visas to accompany the actual investor. Investor's spouse may apply for work authorization with the USCIS.
