Of the various types of non-immigrant visas to the USA, the E category visa is meant for the foreign investors who intend to engage in business in the US. Such potential investors planning to invest a substantial amount of capital in an American enterprise, and who will develop and direct the enterprise, can apply for E2 visa . However the Investor Visa USA can be granted only if there is a Treaty of Commerce and Navigation between the applicant's country and the US (currently 65 countries have such treaty with the US).
If the investor is located in the US, he/she may apply to the US Citizenship and Immigration Services ( USCIS ) for a change of status, extension of stay, or change of employment. In case the investor is outside the US, the E2 category does not require a petition for employment. In such case, the investor can apply for the E2 visa on his or her own behalf directly to a US consular office abroad. The visa-holders can reside in the United States as long as they continue to maintain their entrepreneurial status.

E2 Dependents :
Spouses and unmarried children (under age 21), irrespective of nationality, are eligible for derivative E visas to accompany the actual investor. Investor's spouse may apply for work authorization with the USCIS.
