Judiciary of San Marino is a constellation of judging magistrate, commissioner of the law, the juvenile court, the appellate judge and the judge of last appeal. The judiciary in San Marino works independently of the executive and the legislature.
San Marino judiciary gives the power of trying civil and penal cases to the commissioner. However, penalties beyond 3 years cannot be given. Judiciary of San Marino gives the power to the judging magistrates to deal with all other cases. They serve the office for a period of 3 years. However, they can be re-appointed.
There is also a local conciliation judge who has got the power to deal with petty cases. The lower court judges in San Marino are Italians. This is basically done to maintain a level of impartiality. Council of Twelve is the final court of review in San Marino. They serve the office for a period of 6 years. They are elected from the members of the Grand and General Council.
It was on 28th April, 2005 that a constitutional court was established in San Marino as per the rules and regulations of a new act. This court comprises of 3 alternate and 3 standing judges. They are appointed for a period of 4 years by the Great and General Council.
The jails in San Marino have been able to meet up the international standards.
