The Luxembourg Judiciary has got similarity with that of the French Napoleonic Code. But in fields of penal and commercial divisions, the judiciary of Luxembourg has got similarity with the Belgian Code of law.
It is the monarch who appoints the judges on a lifetime basis for all the courts in Luxembourg. The judiciary in Luxembourg can be mainly divided into two:
Judicial courts and tribunals comprising of 3 Justices of the Peace, 2 district courts, and 1 Supreme Court of Appeals.
Administrative courts and tribunals comprising of State Prosecutor's office, administrative courts and tribunals and the Constitutional Court.
About Luxembourg Judiciary
The judiciary in Luxembourg works independently. It is the Constitutional Court that is at the top of the hierarchy of the judicial system in Luxembourg. The courts and tribunals are entitled to exercise their judicial power in Luxembourg. The 3 justices of peace deal with minor cases of importance. The two district courts are located at Diekirch and Luxembourg.
The Superior Court of Justice is composed of the three branches of the Court of Cassation, Court of Appeal and a department of public prosecution. The Court of Cassation has got a bench of five judges and the Court of Appeal has nine benches of three judges each.
