The Hungary constitution came into existence while the country was still under communist rule. It was only after achieving freedom from communist rule, that the constitution was revised so that it reflected the rules and regulations that would be needed to govern a new republican Hungary. The Parliament had passed a law for a multi-party democratic election and a direct presidential election and this legislation in its wake gave the Hungarians civil and human rights. The legislation further called for a governmental structure in which all the 3 departments of executive, legislative and judiciary were separated. A new revised form of the old Constitution of Hungary, which was adopted in the year1949 under the Communist rule, was once again adopted and stated to be the new constitution of the country.
Hungary Constitution states that the country is a republic, is independent and has been stated to be a democratic constitutional state. The Parliament or the National Assembly is the supreme body, which passes legislations for the effective running of the country. The members to the Parliament are elected through the process of a general electoral system, wherein people exercise their sovereign rights. The Constitution states that it is the duty of the republic to protect the sovereign rights of its people. The Supreme Court is the apex body within the judiciary of Hungary, whereas the main administrative function is done by a special 11 member Constitutional court that is concerned with viewing the validity of a legislation.
