Sri Lanka Supreme Court


The highest court of the country, Sri Lanka Supreme Court, is the final court of records. Every one within the country is to abide by the judgments passed by the Court in accordance to the Constitution of Sri Lanka. The Supreme Court of Sri Lanka is above all other lower courts of the country. The Sri Lanka Supreme Court follows the mixed judicial procedure of a combination of both the common-law and civil law. Hon. Sarath Nanda Silva is the present Chief Justice of the Sri Lanka Supreme Court.

Constitution of the Supreme Court

Following the new constitution of the country, the Supreme Court of Sri Lanka was incorporated in the year 1972. As per the Article 119 of the Constitution, there will be one Chief Justice in the Supreme Court. The number of other judges serving in the Supreme Court ranges between six to ten. The President is responsible for the appointment and removal of all the judges of the Supreme Court. The Supreme Court judges are not allowed to hold any other office without the consent of the Constitution or the President. The retirement age of the judges are fixed at 65 years as per the Constitution.

Jurisdiction of the Supreme Court

The Sri Lanka Supreme Court, in accordance to the Article 118 of the Constitution, is recognized as the final authority to exercise original, advisory, and appellate judicial functions. It is also the final Court of Record and the Court of Appeal of Sri Lanka. The jurisdiction of the Supreme Court of Sri Lanka includes-
  • Jurisdiction for the protection of fundamental rights
  • Consultative jurisdiction
  • Jurisdiction in respect of Constitutional matters
  • Jurisdiction in respect of any breach of the privileges of Parliament
  • Final appellate jurisdiction
